Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of Quotely, an online medical aid and gap cover quoting tool for financial advisors (the “Service”). The Service is operated by Knowyourclients (Pty) Ltd trading as KYC Pro / Quotely (“Quotely”, “we”, “us”, “our”). By creating an account, starting a free trial, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who may use Quotely

The Service is intended for use by financial services providers and their authorised representatives and staff. By registering you confirm that you are duly authorised under the Financial Advisory and Intermediary Services Act, 2002 (“FAIS”) to render the financial services in connection with which you use the Service, or that you are acting under the supervision of such a person. You are responsible for ensuring your use of the Service complies with all laws and regulatory obligations applicable to you.

2. Your account

You must provide accurate, current and complete information when registering, including your name, firm and FSP number. These details are recorded on the quotes you generate as the advising representative and, once saved, are locked to your account for compliance purposes. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us immediately of any unauthorised use.

3. Free trial

New accounts receive a free trial period of seven (7) calendar days from first sign-in, during which you may access the Service at no charge. No payment details are required to begin the trial. At the end of the trial your access will be suspended until you activate a paid subscription. We may modify, shorten, extend or withdraw the trial offer at any time. The trial is intended for genuine evaluation and may be limited to one per person or firm.

4. Subscription and fees

  • The subscription fee is R249.99 per month per advisor, inclusive of VAT where applicable, charged in advance.
  • Payments are processed by PayFast. By subscribing you authorise a recurring monthly charge until you cancel.
  • Your subscription renews automatically each month. You may cancel at any time via your PayFast account or by contacting us.
  • Cancellation stops future renewals; the Service remains available until the end of the paid period. Fees already paid are non-refundable except where required by law.
  • We may change the fee on reasonable notice. Continued use after a change takes effect constitutes acceptance of the new fee.

5. Quotes are indicative — your responsibility to verify

Quotely provides comparison and quoting tools based on plan, premium, benefit and network data compiled from product providers. This data may change without notice and may contain errors or omissions. All quotes, premiums, benefits, hospital network results and comparisons generated by the Service are indicative only and are not an offer, recommendation or guarantee of cover, price or eligibility.

You remain solely responsible, as the advising representative, for verifying every figure and benefit against the relevant provider’s current official material before relying on it or presenting it to a client, and for the suitability, accuracy and FAIS-compliance of any advice you give. The Service is a tool that supports your advice process; it does not replace your professional judgement or your record-of-advice obligations.

6. Acceptable use

You agree not to: use the Service unlawfully or in breach of any regulatory obligation; share, resell or sublicense access to your account; scrape, copy or extract the underlying plan data other than for legitimate quoting of your own clients; attempt to gain unauthorised access to the Service or its systems; or upload unlawful, infringing or harmful content.

7. Intellectual property

The Service, including its software, design, branding and compiled data sets, is owned by or licensed to Quotely and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service for your own advisory business during your subscription. You retain ownership of the client information you enter.

8. Data protection (POPIA)

We process personal information in accordance with the Protection of Personal Information Act, 2013 (“POPIA”). When you capture client information in the Service, you act as the responsible party for that information and you warrant that you have a lawful basis to process it; Quotely acts as your operator and will process it only to provide the Service. We apply reasonable technical and organisational measures to safeguard data. See our privacy practices or contact us for details.

9. Availability

We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may suspend access for maintenance, updates or security, and may modify or discontinue features at any time.

10. Disclaimers and limitation of liability

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including as to accuracy, completeness or fitness for a particular purpose. To the maximum extent permitted by law, Quotely is not liable for any indirect, incidental or consequential loss, or for any loss arising from reliance on quotes, premiums, benefit or network data, or from your advice to clients. Where liability cannot lawfully be excluded, our total liability for any claim is limited to the subscription fees you paid in the three (3) months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under South African law.

11. Indemnity

You indemnify Quotely against any claim, loss or expense arising from your use of the Service, your breach of these Terms, or any advice or service you provide to your clients.

12. Suspension and termination

We may suspend or terminate your access if you breach these Terms, fail to pay, or use the Service in a way that poses a legal or security risk. You may stop using the Service and cancel your subscription at any time.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified by reasonable means. Your continued use of the Service after changes take effect constitutes acceptance.

14. Governing law

These Terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction over any dispute.
